- Thanks for using our online platform and marketplace (“Services”). The Services are provided by CARDCore Limited. (“CARDCore”), located at Unit 8, Level 15, Menara, One Mont Kiara, Mont Kiara 50480 Kuala Lumpur, Malaysia.
- By using our Services, you are agreeing to these terms. Please read them carefully.
Using our Services
1.3 You must follow any policies made available to you within the Services.
Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide.
- You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
- Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.
- Our Services display some content that is not CARDCore’s. This content is the sole responsibility of the entity that makes it available.
- In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.
- Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.
Your SmartCardMarket.Com Seller’s Account
- In order to become a SmartCardMarket Seller, you must first purchase an applicable Lead Generation Package, as well as sign and agree to these Terms & Conditions.
- Upon payment of your first Lead Generation Package Invoice, your SmartCardMarket Seller Account will be activated.
Pricing (Sign up this week only for 0% Commission)
2.0 All pricing is in United States Dollars (USD)
2.1 All pricing excludes tax and CARDCore is not responsible for any local taxes your government may require you to pay.

Privacy and Copyright Protection
3.1 CARDCore’s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that CARDCore can use such data in accordance with our privacy policies.
3.2 We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the U.S. Digital Millennium Copyright Act.
3.3 We provide information to help copyright holders manage their intellectual property online. If you think somebody is violating your copyrights and want to notify us, you can find information about submitting notices and CARDCore’s policy about responding to notices on our website.
Your Content in our Services
4.1 Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.
Modifying and Terminating our Services
5.1 We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.
5.2 You can stop using our Services at any time, however you must honour any projects that you have successfully bid on. CARDCore may also stop providing Services to you, or add or create new limits to our Services at any time. CARDCore will provide you with 30days notice before modifying its pricing structure (Clause 2.2). Changes in pricing structure (Clause 2.2) will not effect any existing bids you have in the marketplace.
5.3 We believe that you own your data and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that Service.
Our Warranties and Disclaimers
6.1 We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don’t promise about our Services.
6.2 Other than as expressly set out in these terms or additional terms, neither CARDCore nor its suppliers or distributors make any specific promises about the Services. For example, we don’t make any commitments about the content within the Services, the specific functions of the Services, or their reliability, availability, or ability to meet your needs. We provide the Services “as is”.
6.3 In the event that we provide you with a customer lead and you can prove that you have received the same lead, or have communicated with the customer in the preceding 7days, we agree to refund you the cost of that said lead.
6.4 In accordance with clause 6.3, you will still be obligated to pay for the customer lead cost, in the following examples:
- You have done business with the customer 1month or 1year ago.
- You or your employees are friends or went to school with the customer lead contact.
- You have evidence that they exist in your database.
- You quoted them 8days or more ago.
Liability for our Services
7.1 When permitted by law, CARDCore, and CARDCore’s suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
7.2 To the extent permitted by law, the total liability of CARDCore, and its suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services (or, if we choose, to supplying you the Services again).
7.3 In all cases, CARDCore, and its suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.
7.4 We recognize that in some countries, you might have legal rights as a consumer. If you are using the Services for a personal purpose, then nothing in these terms or any additional terms limits any consumer legal rights which may not be waived by contract.
Business uses of our Services
8.1 If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify CARDCore and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
About these Terms
9.1 We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.
9.10 If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
9.11 These terms control the relationship between CARDCore and you. They do not create any third party beneficiary rights.
9.12 If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
9.13 If it turns out that a particular term is not enforceable, this will not affect any other terms. The courts in some countries will not apply Malaysian law to some types of disputes. If you reside in one of those countries, then where Malaysian law is excluded from applying, your country’s laws will apply to such disputes related to these terms. Otherwise, you agree that the laws of Malaysia., will apply to any disputes arising out of or relating to these terms or the Services. Similarly, if the courts in your country will not permit you to consent to the jurisdiction and venue of the courts in Kuala Lumpur, Malaysia, then your local jurisdiction and venue will apply to such disputes related to these terms. Otherwise, all claims arising out of or relating to these terms or the services will be litigated exclusively in the federal or state courts of Kuala Lumpur, Malaysia, and you and CARDCore consent to personal jurisdiction in those courts.

10.1 Either party may terminate this agreement at any time, with a minimum of 7days notice. Each party should contact the other in writing by email. Please email CARDCore at email@example.com with the subject : Termination of Partnership Agreement.
11.1 CARDCore may or may not include a certain number of leads for free to certain partners in certain regions. If this is the case and you have been offered a certain number of free leads to join this program, please note that your Account Manager will apply these as a credit to your first invoice.
12.1 When a Seller bids on a Project, they stipulate what their payment terms are. The Buyer must pay the Seller directly and according to the agreed payment terms.
12.3 CARDCore will charge the Seller for Lead Generation Packages, which must be prepaid by TT Payment or Credit Card.
12.4 In the event of a dispute, CARDCore will help mediate between the Buyer and Seller and to ensure that a fair and equitable outcome has been reached.
12.5 As part of the Services, CARDCore will provide free ISO Quality Testing of the product, from its Laboratory in Malaysia. The party initiating the dispute is oblidge to provide CARDCore with a sample of the disputed product, for testing purposes.
12.6 CARDCore acts as a 3rd party, without bias and aims to provide both the Buyer and the Seller with truthful and factual testing results.
